			<content:encoded><![CDATA[<p>Last week, the U.S. Attorney for the Southern District of New York charged 17 Russian-speaking employees and associates of two Holocaust-restitution funds with <a href="http://www.nytimes.com/2010/11/10/nyregion/10holocaust.html">defrauding</a> the claims programs of $42 million. The suspects allegedly recruited Russian-speaking applicants and either doctored or invented claim-worthy stories on their behalf.</p>
<p>For me, the news served as a doleful affirmation: The alleged criminals seem to have had the same thought I did when I filled out my now-deceased grandmother&#8217;s application for reparations years ago. The details of <em>her</em> story were true: She spent 26 months incarcerated in the Minsk ghetto, managing to escape a month before it was liquidated and her parents and maternal grandparents were murdered. But as I considered the application’s thin verification requirements, I thought: How easy this would be to fake.</p>
<p>So I did.</p>
<p>For the last year, I have been inventing stories of Holocaust suffering: a mother suffocating her wailing child to save the other Jews hiding in a cellar; a ghetto work detail sorting the blood-spattered clothes of murdered Jews; Belarussian Nazi collaborators pausing between executions at street tables loaded with chicken and beer. But rather than feeding some criminal scheme, these stories are at the heart of a novel I’ve been writing—the story of a young writer, a failure in New York magazine journalism, who, in frustration, takes to forging Holocaust restitution claims at the prompting of old Soviet Jews in Brighton Beach and other parts of Soviet Brooklyn.</p>
<p>In the book, as in real life, these are people who have suffered unimaginably—as Red Army soldiers in World War II; as Jews in the Soviet Union; as immigrants in the United States—but not in the way the Conference on Jewish Material Claims Against Germany specifies they need to have suffered to qualify for the reparations the German government has been making to Holocaust victims since 1952.</p>
<p>Slava Gelman, my fictionalized letter-writer, wants to resist the logic of these old immigrants even as his heart breaks at their misery. He, too, is a Soviet émigré; his elders brought him to America so he wouldn’t have to live by the deception that they did. In the Soviet Union, Jews were kept out of elite institutions and posts; Jewish veterans who had lost limbs at the front were taunted for having sat out World War II; a Jewish woman could hardly touch a loaf of stale bread at the food store without having her “grubby Jewish fingers” berated by the cashier. Soviet Jews lived in an inconceivable limbo of unfairness and hypocrisy. Many would have been too happy to forget their faith, but their countrymen never allowed them to.</p>
<p>I was also born in the Soviet Union, where Jews like my grandfather had no choice but to live by the black market. Ostensibly a barber, my grandfather developed a clandestine barter network that would impress a CIA station chief. A haircut on the side for a stick of salami; salami for free Aeroflot tickets; free tickets for the ear of a powerful person in case trouble comes. The only way to get by was to cheat the system—there simply wasn’t enough to go around fairly. It’s hard to think of a regime that claimed to do as much in the name of its people while impoverishing them more—materially, physically, morally. It’s hard to fault an ex-Soviet person for feeling owed. But, as a character in the novel says, “the Soviets aren’t offering restitution. The Germans are offering.”</p>
<p>***</p>
<p>The low burden of proof required by the reparations program wouldn’t tempt the average American: The law is the law here. That is the wonder of this country, for all its flaws: There’s enough to go around. Connections, pedigree, and money all help, but so many ordinary people can achieve what they’d like simply by working fairly and honestly. You can afford to be decent here.</p>
<p>Had the defrauded funds been American rather than German, it isn’t hard to imagine the news sticking in some immigration-obsessed Tea Party congressman’s craw, with its easy iconography of interlopers illegally sucking down precious native resources. The law is the law; the Holocaust-fund suspects should be prosecuted. So should, for that matter, those who cross the border illegally. But what should find no tolerance is the nativist demonology that so often accompanies news of malfeasance by a small portion of a minority group. The Russians have gotten off easy, their persecution limited to movies like <a href="http://en.wikipedia.org/wiki/Red_Dawn"><em>Red Dawn</em></a> and <a href="http://www.tabletmag.com/scroll/33197/gary-shteyngart-answers-questions/" target="_blank">Gary Shteyngart’s novels</a>. But what of more hideous gestures, such as Nevada Senate candidate Sharron Angle’s <a href="http://www.youtube.com/watch?v=tb-zZM9-vB0   ">video</a> of faceless Mexican marauders scaling the walls of our innocent land? The vast majority of illegal Mexican immigrants are here to make money to put clothes on the backs of children in Puebla—money earned doing work most Americans won’t deign to do, and for a pittance. Since so much modern journalism seems to have squandered its traditional mandate to force primitive instinct to contend with nuance, perhaps fiction has to step in.</p>
<p>The poison inside the people who allegedly defrauded the Holocaust fund would be inside you, too, if you had lived as Jews in the Soviet Union. Whatever their sins, these people are heroes, too, for having survived it. The struggle to defeat its legacy requires a daily application of conscience and will, even for members of my generation. I actually envy Slava, my own fictionalized protagonist, for the way in which he chooses America at the end of the book. Fiction is freeing that way; that’s one of its limiting seductions. For some, in real life, it&#8217;s simply too late.</p>
<p>Nothing is more uplifting than the American gospel of self-reinvention, but America forgets that human nature sometimes has a limit. That is part of America’s vital, ferocious, oblivious beauty. But it’s too late for those who traded their complimentary American synagogue memberships for cash; for those who sign for imaginary pills and massages to split profits with doctors who file for Medicare reimbursement; for those for whom it’s still 1977 in Minsk.</p>
<p>Slava spends only the 400 pages of my book arguing with his grandfather about the meaning of justice; I have spent more than a decade arguing with mine. In this time, I have achieved things I never imagined, but I have changed nothing about what men like our grandfathers see in the world. That creates one kind of conundrum for the American legal system, and another for Russian-Americans of my age. Our grandparents are our shame, but they are also our wisdom, courage, and tenderness. They gave up everything so we could have more. But in the United States, they remain Soviet—that singular cocktail of cunning, fear, paranoia, ambition, materialism, anti-intellectual refinement, tribalism, prudery, soul. It is the lasting curse of our magical, hideous birthplace. How do you forgive and revere these people at once? How do you honor someone whose definition of honor is entirely different from yours?</p>
<p>I found my only answer in fiction: Consider them individually, as the idiosyncratic, reduction-imploding human beings that they—that we all—are.</p>

			<content:encoded><![CDATA[<p>Jonathan Pollard, who is now marking his 24th year in prison, has earned the dubious record of serving the longest prison term in American history for spying for an ally. Convicted of espionage in 1987, Pollard was the suburban American Jewish dream turned nightmare: a good, middle-class, high-achieving boy turned traitor. The son of a college professor, smart enough to graduate from Stanford, patriotic enough to be hired to work in naval intelligence, he made a criminal decision to betray his country to help Israel.</p>
<p>And yet new petitions on his behalf have recently begun to circulate, and gain momentum, both in the U.S. Congress and the Israeli Knesset. This is, in large measure, because Pollard’s situation rests on a contradiction: He was guilty of a reprehensible crime, and yet he has been treated abominably. One of the most infamous Jewish criminals in modern times, he is also the victim of the worst act of official American anti-Semitism in our lifetimes. With his round face and shoulder-length hair, Pollard today still looks more like a perpetual grad student than an arch criminal, but he has suffered severely. He has served hard time, mostly in maximum-security prisons, spending years in lockdown 23 hours a day. Websites pleading his case detail his medical ailments, <a href="http://www.freepollardnow.com/downloadpetition.php">noting</a> that he has “developed diabetes, high blood pressure, high cholesterol, pre-glaucoma, and arthritis while in prison.”</p>
<p>From the moment he was sentenced, there were people in the Jewish community—and beyond—who believed Pollard had been unjustly punished and who fought for his release. But they were few and far between, and they often made the wrong case for him. This newest round of argument on Pollard’s behalf is different. For starters, many of his champions have been careful not to lionize him. Rather, they focus on correcting what Judge Stephen Williams, who filed a dissent in one of Pollard’s failed appeals, deemed “a fundamental miscarriage of justice.” Most surprisingly, on September 27, 2010, a former assistant secretary of Defense confirmed many people’s decades-long fears that, at some point, the case had turned personal—and poisonous. Without explaining what prompted him to break his silence, Lawrence Korb, who served in the Pentagon in Reagan’s first term, <a href="http://www.jonathanpollard.org/2010/092710.pdf">wrote</a> President Barack Obama: “Based on my first-hand knowledge, I can say with confidence that the severity of Pollard’s sentence is a result of an almost visceral dislike of Israel and the special place it occupies in our foreign policy on the part of my boss at the time, Secretary of Defense Caspar Weinberger.”</p>
<p>Decades into this tragic and pathetic tale, American Jewry’s continuing allergy to defending Pollard says more about our communal fears and the price we are willing to pay for social and political acceptance than it does about Pollard and his crimes.</p>
<p>***</p>
<p>On November 21, 1985, FBI agents arrested Pollard, 31 at the time, just outside Israel’s embassy in Washington. Since June 1984, Pollard had been routinely removing sensitive documents from the Naval Intelligence Support Center on Friday afternoons, passing them to his Israeli handlers for Xeroxing, and blithely returning them on Monday mornings. When first interrogated by the FBI, Pollard called his wife. After he worked the word “cactus” into the conversation, their designated SOS code word, Anne Henderson-Pollard scurried about their house—with a neighbor’s help—sanitizing it. The neighbor subsequently gave the FBI a 70-pound suitcase filled with secret documents, reflecting the volume of Pollard’s activities and sloppiness.</p>
<p>Despite transferring thousands of documents to his Israeli handlers, Pollard failed to gain asylum at the embassy on that day in 1985. Backpedaling furiously, Israel first labeled Pollard a rogue agent, as his handlers worked out of a shadowy organization called Lekem, the Defense Ministry’s Bureau for Scientific Relations. The department, headed by the legendary Mossad man <a href="http://www.mfa.gov.il/MFA/Government/Personalities/From+A-Z/Rafi+Eitan.htm">Rafi Eitan</a>, was disbanded shortly after Pollard’s arrest. Israel granted Pollard citizenship in 1995—long after such a move could have done him any good. And it wasn’t until 1998 that Israel finally acknowledged what everyone knew: Pollard had been an authorized agent spying for Israel.</p>
<p>An American Jew’s arrest as an Israeli spy was upsetting enough for American Jews. But Pollard’s defense made the affair excruciating. Minimizing the thousands of dollars he earned, the diamond-and-sapphire ring the Israelis gave him, and his efforts to shop American secrets to South Africa and possibly Pakistan, too, Pollard portrayed himself as a Zionist idealist. Anti-Semites bullied him as a child, he recalled. He claimed that the documents he smuggled out, so crucial to Israeli security, should have been shared freely. And, using a most obnoxious and threatening term, he said a “racial obligation” compelled him, as a Jew, to defend the Jewish state.</p>
<p>Suddenly, amid Ronald Reagan’s resurgence of hard-bodied patriotic machismo, in the age of Sylvester Stallone’s <em>Rambo</em> and Clint Eastwood’s tough-guy “make my day” taunt, a balding, mustachioed, jowly-faced American Jewish nerd in glasses was betraying the red, white, and blue for the blue and white. Pollard’s crimes epitomized Zionism-run-amok, with the ideological implications of Jewish tribal solidarity pushed to its extreme.</p>
<p>“I feel my husband and I did what we were expected to do, and what our moral obligation was as Jews, what our moral obligation was as human beings, and I have no regrets about that,” Anne Pollard <a href="http://www.jewishvirtuallibrary.org/jsource/myths/mf21.html#p">said</a> defiantly on <em>60 Minutes</em> shortly before being sentenced, one of many arrogant, self-destructive moves the couple made back then. While stirring up the terrifying “dual loyalty” charge—far more terrifying to Jews than to Irish-Americans and other hyphenated Americans—the Pollards defined every Jew’s ultimate loyalty as being to the Jewish state. Desperately repudiating the charge, the prominent academic Jacob Neusner would declare America to be the true “promised land.”</p>
<p>This American Jewish skittishness regarding Pollard was particularly surprising because by the 1980s American Jews were thriving in America’s suburban meritocracy. Some American Jewish superstars were accented immigrants like former Secretary of State Henry Kissinger and the winner of the 1986 Nobel Peace Prize, Elie Wiesel. But most American Jewish success stories were 100 percent American. Speaking unaccented English, they were supposed to be unscarred psychologically, unapologetically American.</p>

<p>American Jews had been here before. Three decades before Pollard made headlines, <a href="http://www.fbi.gov/about-us/history/famous-cases/the-atom-spy-case/the-atom-spy-case"> Julius and Ethel Rosenberg’s</a> arrest, trial, and conviction as Soviet spies for stealing atomic secrets rendered the American Jews’ nightmare scenario in pinkish hues. But in the 1950s, American Jews were greener, more marginal. Julius Rosenberg represented the intellectual, foreign-born, New York Jew as Communist, at a time when Communism was disproportionately popular among Jews.</p>
<p>With the Rosenbergs—as with the Pollards—the rightness of finding them guilty was often confused with the wrongness of their punishment. The zeal with which they were prosecuted, the way Judge Irving Kaufman presided over their trial, and Ethel Rosenberg’s unjust execution along with her husband, all suggested something deeper in both the American Jewish psyche and the larger American political culture. The American legal establishment particularly enjoyed prosecuting these treasonous Jews, while many American Jews leapt to prove their own loyalty—at the Rosenbergs’ expense.</p>
<p>Just as in the Rosenberg case, the judge presiding over Pollard’s sentencing was swayed to render too harsh a punishment—a decision that kicked up new waves of suspicion and anxiety.</p>
<p>In an effort to keep his wife out of prison, Pollard pleaded guilty to one count of espionage. His wife, Anne, then 26, pleaded guilty to the milder charge of illegally possessing classified documents. In return, the prosecutor asked the judge to punish Pollard with a “substantial number of years in prison.” During the sentencing phase, one voice proved damningly influential. In a secret 46-page-pre-sentencing “damage-assessment memorandum” sent to the judge—and an additional four-page memo that was recently <a href="http://original.antiwar.com/weinberger/2010/10/17/caspar-w-weinberger-jonathan-pollard/">declassified</a>—Secretary of Defense Caspar Weinberger made a fierce argument. “It is difficult … to conceive of a greater harm to national security than that caused by the defendant in view of the breadth, the critical importance to the U.S., and the high sensitivity of the information he sold to Israel,” <a href="http://www.irmep.org/ila/pollard/03041987weinberger.pdf">wrote</a> Weinberger, before adding—malevolently and unnecessarily—that Pollard’s “loyalty to Israel transcends his loyalty to the United States.”</p>
<p>Judge Aubrey Robinson Jr., of the U.S. District Court for the District of Columbia, sentenced Jonathan Pollard to life in prison and his wife to five years. (After Anne Henderson-Pollard served three-and-a-half years, she was paroled. Jonathan Pollard divorced her so she could rebuild her life without him.) The sentence was surprisingly harsh. By comparison, in 1987 Sgt. Clayton Lonetree, who’d been seduced by a Soviet agent, became the first Marine ever convicted of espionage. His crimes compromised agents and the American embassy in Moscow. Yet a military court—under Weinberger’s direct authority—sentenced Lonetree to 30 years in prison, and he eventually served nine years. Richard Miller, an FBI agent who spied for the Soviets in the 1980s, served 13 years. Spies for other allies, like Saudi Arabia, South Africa, Egypt, and the Philippines, served anywhere from two to four years, with maximum sentences of 10 years. Pollard’s extreme sentence—along with the continuing refusal to free him–has raised questions about official American anti-Semitism and whether Pollard is enduring harsher punishment for the crime of being an American Jew spying for Israel.</p>
<p>Given that neither Weinberger nor Robinson ever explained their actions, the Pollard case remained shrouded in this noxious mystery. Years later, Weinberger would skip over the case in his memoirs and, when asked about the omission, would dismiss the Pollard case as a “very minor matter.” But it’s clear that his accusation that Pollard committed “treason”—and harmed the nation—had a devastating impact.</p>
<p>In his recent letter, Lawrence Korb <a href="http://www.jpost.com/International/Article.aspx?id=191208">suggested</a> that Weinberger, his former boss, had exaggerated the damage Pollard caused and that an anti-Semitic bias distorted the case. From the start, some speculated that Weinberger, who had Jewish grandparents but was a devout Episcopalian, sacrificed Pollard to exorcise his own ancestral demons. There was something about this pudgy, sloppy, unapologetic Jewish spy for Israel that repulsed Weinberger. Weinberger was also one of the Reagan Administration’s leading Israel skeptics. Caught in a power struggle with the pro-Israel Secretary of State George Shultz, Weinberger usually viewed the Jewish state as more albatross than asset.</p>
<p>More benign observers guessed that the secrets Pollard spilled did more damage to U.S. interests than Pollard or the Israelis suggested. Perhaps, some argued, Russian spies secured key codes thanks to Israeli-based KGB agents. Others assumed Pollard received instructions from a higher-level mole who remains unexposed. After Aldrich Ames’ <a href="http://news.bbc.co.uk/onthisday/hi/dates/stories/april/28/newsid_2501000/2501007.stm">arrest for spying</a> in 1994, some speculated that Weinberger and others may have blamed Pollard for the damage Ames had actually caused, including the deaths of as many as 10 CIA assets. The author John Loftus and others theorized that Ames, who was a top CIA counter-intelligence official, probably pinned his own crimes on Pollard. In 1995, <em>Moment</em> magazine editor Hershel Shanks would quote Loftus quoting naval intelligence “sources” who admitted that “90 percent of the things we accused [Pollard] of stealing, he didn’t even have access to.”</p>

<p>After Pollard’s sentencing, <em>New York Times</em> columnist William Safire <a href="http://www.nytimes.com/1987/03/09/opinion/essay-the-pollard-consequences.html">warned</a> that Pollard encouraged “anti-Semites who charge that Jews everywhere are at best afflicted with dual loyalty and at worst are agents of a vast fifth column.” Issuing a personal declaration of independence from Israel, Safire proclaimed: “American supporters of Israel cannot support wrongdoing here or there. In matters of religion and culture, many of those supporters are American Jews, but in matters affecting national interest and ultimate loyalty, the stonewalling leaders of Israel will learn to think of us as Jewish Americans.”</p>
<p>But one keen observer of American Jewry, the political scientist Daniel Elazar, <a href="http://www.jcpa.org/dje/articles2/pollard.htm">noticed</a> that it was American Jews—and not their non-Jewish neighbors—who were actually raising the dual-loyalty specter, “apparently in the hope of preventing the issue from surfacing by raising the charge in order to deny it. Even more frequently, it was raised by Jews in the media, most of whom were highly assimilated but still apparently needed to demonstrate their ‘bona fides’ as Americans.” Elazar concluded: &#8220;The level of American Jewish insecurity is astounding.”</p>
<p>American Jews still viewed themselves and their community as on probation in the United States, with their ultimate acceptance conditional on good behavior. This pathology would be stated clearly, if unconsciously, years later, by one of the highest-ranking Jews in American history, who served his country nobly as director of naval intelligence from 1978 to 1982 and yanked Pollard’s security clearance—temporarily—years before the spying began. Rear Admiral Sumner Shapiro sounded like a scared yid when discussing Pollard. Annoyed at fringe American Jewish groups that defended Pollard, Shapiro <a href="http://www.washingtonpost.com/wp-dyn/content/article/2006/11/16/AR2006111600153.html">told</a> the<em> Washington Post</em> in 1998:  “We work so hard to establish ourselves and to get where we are, and to have somebody screw it up &#8230; and then to have Jewish organizations line up behind this guy and try to make him out a hero of the Jewish people, it bothers the hell out of me.”</p>
<p>All minorities want to celebrate their tribal successes as reflecting the best of their people without being tarred when one of their own acts poorly. And given the torturous history of anti-Semitism, American Jews feel this intensely. We circulate lists of Jewish Nobel prize winners, delighting in each American Jewish success, using Jewish achievements to validate our rich but complex Jewish baggage. And while we reserve the right to cringe when a Bernard Madoff becomes the modern face of the greedy Jew or a Jonathan Pollard becomes the modern face of the traitorous Jew, we also reserve the right to object when our neighbors make similar leaps from the one bad apple to the whole bunch.</p>
<p>Nearly two years after Pollard’s arrest, with the sentencing returning the case to the headlines, the Israeli academic Shlomo Avineri zeroed in on this American Jewish insecurity—and inconsistency. Writing in the <em>Jerusalem Post</em>, first condemning Pollard as a traitor and his own government as clumsy, Avineri <a href="http://books.google.com/books?id=f6clJqe_Ak0C&amp;lpg=PA57&amp;ots=WjTv7He_q7&amp;dq=nervousness%2C%20insecurity%2C%20and%20even%20cringing&amp;pg=PA57#v=onepage&amp;q&amp;f=false">mocked</a> the “nervousness, insecurity, and even cringing” of American Jews. Playing the role of the abrasive Israeli—or biblical prophet—Avineri wrote: “Today, American Jewish leaders by their protestations of over-zealous loyalty to the United States at a moment when no one is really questioning it, are saying that America in the long run is no different from France and Germany. When you have to over-identify, there is no other proof needed that you think that your non-Jewish neighbors are looking askance at your Americanism. You are condemned by your own protestations of loyalty and flag-waving.” At a time when Israel’s actions made it unpopular with many American Jews, Avineri’s aggressively Zionist analysis only exacerbated tensions.</p>

<p>The controversy–and speculation–peaked during the <a href="http://en.wikipedia.org/wiki/Wye_River_Memorandum">Wye River negotiations</a> between Israel and the Palestinians in October 1998. Benjamin Netanyahu, in his first round as Israel’s prime minister, lobbied hard for Pollard’s release. President Bill Clinton seemed set to free him as a sweetener to Israel until the CIA director, George Tenet, threatened to resign. Such power politicking against a spy who had been imprisoned for over a decade reinforced both camps’ speculation. Those who fear anti-Semitism say this irrational move reflects a deep aversion in the WASP-iest bastions of the American government. Those who believe Pollard did more damage than we know insist that the usually mild-mannered Tenet had a good reason to be so rigid.</p>
<p>To Israeli settlers, Pollard’s case symbolizes the anti-Semitism of even benign non-Jewish polities such as the United States and the weak-kneed appeasement policies of successive Israeli governments, which have failed to free Pollard. The most popular pro-Pollard bumper sticker in Israel simply appeals for Pollard to come home “<em>haBaytah</em>,” but a few years ago one poster challenged: “BUSH: FREE YOUR CAPTIVE.” This poster not only targeted a good friend of Israel’s, George W. Bush, but it pictured Pollard with the young Israeli Hamas is holding, Gilad Shalit. The implicit comparisons, between the innocent Shalit and the guilty Pollard, as well as between the democratic United States and the terrorist-state Hamas, were offensive. While the right’s support has sustained Pollard emotionally, it may have made his get-out-of-jail card even harder to get. The Israeli right is unpopular with both the American Jewish community and the American political establishment, making Pollard even more unappealing.</p>

<p>However unappealing he may be, the time has come to free Jonathan Pollard—not as some sop to Israelis but as a matter of justice. Holding an individual hostage to the vagaries of the never-ending Israeli-Palestinian diplomatic process is cruel and unusual punishment. The Pollard case has become a question of justice, American-style, unrelated to American-Israeli relations. And justice when applied too zealously becomes unjust. For decades, the American Civil Liberties Union and other civil-rights organizations have taught that we take up certain criminals’ cases not because we like the criminals or excuse their crimes but because, at a certain point, it becomes the right thing to do.</p>
<p>Imagine another case in which an accused man served a disproportionately long sentence after being tried in a court where direct pressure was applied by the secretary of Defense for reasons that may well have been mistaken or personally motivated. If there was another such case, one imagines that it would attract lots of attention from the ACLU and other groups concerned with the civil liberties of Americans. So why are they silent? More to the point, why are we silent?</p>
<p>If the Pollard case represents the worst of American anti-Semitism, then, by historic standards, anti-Semitism American style is mild indeed. Still, that American Jews, despite their long record of defending the underdog, still hestitate to champion Pollard’s release now, suggests that we—like Jonathan Pollard—remain victims of the “astounding” insecurity Elazar witnessed two decades ago.</p>

			<content:encoded><![CDATA[<p>The CIA knowingly <a href="http://www.nytimes.com/2010/11/14/us/14nazis.html?_r=1&#038;hp">permitted</a> some former Nazis &#8216;safe haven&#8217; in the United States after World War Two to an extent previously not publicly understood, according to a Justice Department <a href="http://documents.nytimes.com/confidential-report-provides-new-evidence-of-notorious-nazi-cases?ref=us#p=1">report</a> kept secret for four years but obtained by the <i>New York Times</i>. Among the revelations in the 600-page document, which Justice says was six y’ears in the making and never formally completed:</p>
<p>• The CIA knew early on that Tscherim Soobzokov, who was killed in New Jersey by the Jewish Defense League, had been a Waffen SS agent, despite court filings stating the contrary. </p>
<p>• Otto Von Bolschwing, who aided Adolph Eichmann in planning the extermination of the Jews of Europe, was the subject of a series of CIA memos concerning what the agency should do if Von Bolschwing&#8217;s background ever came up—that is, after he had gained admittance to the United States, where he lived until his 1981 death. <span id="more-50444"></span></p>
<p>• Intelligence officials were more aware, and earlier than was known, that Arthur Rudolph, who ran a German munitions factory before working on American arms after the war (he has been honored by NASA for helping create the Saturn V rocket), was directly involved in exploiting human labor.</p>
<p>• Justice proved as early as 1997 that Switzerland culpably bought formerly Jewish gold from the Nazis.</p>
<p>• A director of Justice&#8217;s Office of Special Investigations, which was created in 1979 to investigate and deport former Nazis living stateside, kept a piece of skin believed to be a part of Dr. Josef Mengele&#8217;s scalp in a drawer.</p>

			<content:encoded><![CDATA[<p>The two package bombs addressed to Chicago synagogues posed quite a puzzle to some U.S. law enforcement officials. Since they “were addressed to religious institutions in Chicago,” <a href="http://abclocal.go.com/wls/story?section=news/local&amp;id=7753847">said</a> FBI Special Agent Ross Rice, “all churches, synagogues, and mosques in the Chicago area should be vigilant for any unsolicited or unexpected packages, especially those originating from overseas locations.”  So, even the Jehovah’s Witnesses are in danger—and Muslims, too? Or maybe the FBI knows of some outstanding quarrel between al-Qaida in the Arabian Peninsula and Louis Farrakhan’s Chicago-based Nation of Islam. Otherwise, why is Special Agent Ross going to such lengths to obscure the obvious fact that the package bombs were not a general attack on people of faith in the greater Chicago area, but an operation directed specifically at American Jews?</p>
<p>Almost as absurd is the theory introduced by British security officials, with some recent <a href="http://www.nytimes.com/2010/11/01/world/01terror.html">support</a> from the White House, that the bombs weren’t going to go off in America at all. Instead, they were going to blow up the <a href="http://www.guardian.co.uk/world/2010/oct/30/cargo-plane-bombs-explode-midair">planes</a> carrying them in mid-air. This narrative is, it seems, mostly substantiated by the fact that a UPS cargo plane crashed in Dubai two months ago—even as there is no <a href="http://www.khaleejtimes.com/DisplayArticle09.asp?xfile=data/international/2010/October/international_October1483.xml&amp;section=international">evidence</a> that this crash was an act of terror.</p>
<p>More to the point, the mid-air explosion thesis needs to explain why the two bombs had already been transported by two air-carriers and yet failed to explode. “This was a potential attack on U.S. business,” explained one British official, “and the impact could have been huge. Damaging the West&#8217;s economy is a key objective of al-Qaida.” But it is not clear how these attacks would have damaged the economy of the West. The practical effect would have been to close down express mail services, like FedEx and UPS, out of Yemen. A 20-minute delay on the New York subway any given Monday morning is apt to affect our trillion-dollar economy more than two cargo planes from Yemen with no passengers blowing up in mid-air. Either al-Qaida has entered the spectacularly pointless and silly phase of its war against the West, or the latest narrative doesn’t wash.</p>
<p>What we do know is that the bombs were addressed to American synagogues—not churches or mosques (or financial institutions)—and that our national security apparatus is visibly uncomfortable dealing with this established fact. Neither the president, nor his spokesman, nor the White House’s counterterrorism czar made much of the notion that this act of terror had specifically targeted the Jewish community. No one denounced the attempted murder of American citizens based on their faith. No one said that foreign maniacs who target Jews are part of a global sickness.</p>
<p>It is unpleasant to have to make the comparison, but instructive nonetheless: Had a mosque been targeted, or had American Muslims been marked for death, we can be sure that the president, rightly, would have denounced not only the act but the idea that it had singled out a particular section of the American people.</p>
<p>As I <a href="http://www.tabletmag.com/news-and-politics/49102/the-message/">argued</a> right after the prospective attack was first announced, we have accustomed ourselves to acts of terror against Jews by rationalizing them. After all, since Israel “occupies” Muslim lands in the West Bank, the Golan Heights, and the Shebaa Farms—and since many people see all of pre-1967 Israel itself as occupied land—it’s not surprising if Jews around the world are going to have their blood spilled because of boundary disputes in the Holy Land.</p>
<p>But that’s not why President Barack Obama and his Cabinet are loath to point out that this thwarted operation constitutes a hate crime. Americans believe that the worst thing you can be accused of is racism, our “original sin,” as the former senator from Illinois once phrased it before he was elected the 44th president of the United States. We assume that other people must feel exactly the same way, even if it is clear they do not, as the Arabs do not. The common word in Arabic for a dark-skinned black person is <em>abed</em>, slave. In Egypt, the butt of almost every joke are the Saidis, those reputedly shiftless, not-too-bright, and dark-skinned inhabitants of Upper Egypt.</p>
<p>The Arabs are not particularly embarrassed by their racist feelings about Jews. Rather than detail the anti-Semitic offerings available all day and night on Arab TV, where wild fantasies about Jews drinking blood and stealing the organs of gentiles occupy the same place that hardcore pornography does on your average hotel pay-per-view menu, suffice it to say that the father of the UAE’s Crown Prince Mohammed bin Zayid, who was <a href="http://www.politico.com/politico44/">thanked</a> on Sunday by White House counterterrorism czar John Brennan for his help in foiling the Yemen package bomb attack, gave his name and financial support to a think tank in Abu Dhabi notorious for its hatred of Jews. The Zayed Center for Coordination and Follow Up <a href="http://www.adl.org/Anti_semitism/zayed_center.asp">hosted</a> Holocaust deniers, promoters of the protocols of the Elders of Zion, and other assorted Arab and Western anti-Semitic intellectuals before it closed in 2003.</p>
<p>The Arabs recognize that we’re very sensitive about racism and anti-Semitism, which is why they know their calling Israeli Foreign Minister Avigdor Lieberman a racist resonates with us—even as the Palestinian Authority’s ambassador to Washington <a href="http://www.tabletmag.com/news-and-politics/48834/qa-maen-areikat/">openly calls</a> for the transfer of all Jews from any future Palestinian state. We are the ones who quiver at the accusation of racism—not them. We would not dream of calling the Arabs anti-Semitic or racist because we fear that we have subjected them to our Western colonial racism, and we feel guilty about it. Indeed, many in the West have even gone so far as to ignore the evidence of 1,300 years of Muslim anti-Jewish polemics to claim that anti-Semitism is a Western import. To call the Arabs anti-Semitic would be shaming a people we have already hurt too much.</p>
<p>All of our noble sentiments toward the Muslim world would be fine, if it weren’t for the fact that our political correctness has created a context where it’s OK to dehumanize, terrorize, and murder Jews.</p>
<p>However, I have to say that when reading the comments to my pieces, I am routinely surprised that some readers appear to believe anti-Semitism is simply about the Jews. That is, that there are some in the Jewish community who would seem to prefer it if someone with a name like Lee Smith would stop stirring the pot and just let it alone. But as I said, anti-Semitism is not just about Jews; after all, it’s not a Jewish idea, any more than the Holocaust was. I like Jews as much as I like the next man on the bus. But I’m not particularly interested in the internal politics of the Jewish community. I am interested in anti-Semitism not just because it sickens me, but because it poisons American society as a whole, affecting both Jews and non-Jews.</p>
<p>If racism is our original sin, then anti-Semitism is the essential test of our character. Our current failure to recognize it and denounce it proves that our enemies have taken our measure. They know who we are. After killing 270 people, many of them Americans, over the skies of Lockerbie in 1988, Abdul Basset Ali al-Megrahi walked out of a Scottish prison last year to pave the way for British oil deals. It is not clear why Megrahi’s release caused shock, disappointment, and anger among American officials who demand the Israelis release Arab prisoners with Jewish blood on their hands as a show of “good faith.”</p>
<p>In Washington, the world’s superpower looks on in detached wonderment as we hazard educated guesses as to whether or not the Israelis are really going to attack the nuclear facilities of a regime that has called for another Holocaust. In our universities, professors <a href="http://www.juancole.com/2010/03/ahmadinejad-calls-911-big-lie-says.html">explain</a> away the Islamic Republic’s threats to destroy the Jewish state by claiming the translations from Farsi are flawed.</p>
<p>It’s not just about the Jews. As the most recent Wikileaks documents show, the George W. Bush Administration deliberately covered up the extent of the Iranian war against the United States in Iraq so as to save itself the trouble of responding to the killing of American soldiers by a foreign government. There was no way the American military was going to open up a third front in the war on terror, reasoning that that only made American soldiers in Iraq and Afghanistan more vulnerable—as well as American civilians at home whose government will not name and pursue their enemies. This is an old habit now of U.S. policymakers, and it knows no party. Democrats and Republicans alike play the same sick game. The Islamic Republic released the American hostages it had taken under the Jimmy Carter Administration to the newly elected Ronald Reagan—who blinked when Iran and Syria, via Hezbollah, killed diplomats and Marines in Beirut.</p>
<p>Rather than making our enemies pay, we’ve let them off time and again over the last 40 years, thus ushering in the golden age of international terrorism, which is helping to capsize the short-lived Pax Americana. Our leaders will not speak frankly to the people who elected them because they fear the American electorate has no stomach for it. War in the Persian Gulf that sends gas to $10 a gallon combined with terror attacks at home would ravage the American economy and our national psyche. So we are silent. And in our silence, monsters breed.</p>

			<content:encoded><![CDATA[<p>Last fall I received a cryptic email from Emad Salem, the ex-Egyptian Army major who was the FBI’s first undercover asset in what would become known as the war on terror. I’d told Salem’s remarkable story in my last three books, which were critical of the bureau’s counterterrorism record. Because I had treated him fairly, Salem reached out to me after years in the Federal Witness Protection Program.</p>
<p>We made plans to meet in early November, after a lecture I was giving at New York University. But Salem didn’t show. I went back to my hotel that night and had chalked it up as a lost opportunity. The phone rang at 2 in the morning. It was Salem, summoning me to a meeting outside 26 Federal Plaza, the building that houses the FBI’s New York office. Very cloak and dagger, but that&#8217;s how this man rolls. You don&#8217;t infiltrate the cell responsible for the 1993 World Trade Center bombing without practicing a little tradecraft. Anyway, when my cab pulled in to Foley Square a few minutes later, Salem was standing in the shadows.</p>
<p>That was the start of a series of interviews that led to some astonishing revelations about two of the most infamous al-Qaida murders since Osama Bin Laden formed his terror network. The first one—in fact, arguably the first blood spilled by al-Qaida on U.S. soil—occurred on the night of November 5, 1990, just after Rabbi Meir Kahane, the founder of the ultra-nationalist Jewish Defense League, finished a speech at the Marriott East Side in New York.</p>
<p>Kahane, a volatile figure who had been expelled from the Israeli Knesset in the mid-1980s and returned to the United States to warn American Jews about what he believed to be a “second holocaust” at the hands of radical Islam, was gunned down by El Sayyid Nosair, an Egyptian émigré. The New York Police Department initially labeled him a lone gunman. I have argued that it was much more than that: an unsolved murder with dire implications for the war on terror.</p>
<p>Now, as a result of new intelligence I’ve learned from Salem, it’s clear for the first time that the rabbi’s death was directly linked to Osama Bin Laden. More surprising, there was a second gunman on the night of Kahane’s murder: a young Jordanian cab driver named Bilal Alkaisi. Alkaisi was also identified in FBI files I’ve obtained as the “emir” of a hit team in a second grisly al-Qaida-related homicide months after the assassination—the 1991 murder of Egyptian immigrant Mustafa Shalabi. The identities of the alleged killers in that second slaying have now become known as a result of information from Salem that prompted the New York Police Department to reopen the Shalabi case.</p>
<p>But the real news is that Alkaisi, originally indicted in the 1993 World Trade Center bombing, was cut loose by the feds in 1994 and presumably remains at large. This new intelligence, about a pair of historic terror-related homicides in New York City, lay buried for years in the files of the Joint Terrorism Task Force—until I obtained them from a government source.</p>
<p>As I tell it in “The Spy Who Came in for the Heat,” an investigative piece I wrote for <em>Playboy</em>’s September issue, Emad Salem was arguably the most important asset in the U.S. war with al-Qaida. But my interviews with him and the intel they have kicked loose provide shocking new insights into the ongoing failure of the FBI to reform its counterterrorism capabilities almost a decade after the Sept. 11 attacks.</p>
<p>In order to fully appreciate the significance of these two murders in the history of the war on terror, we need to go back to the summer of 1989, when George Bush was in the White House and terrorism was considered a backwater assignment at the FBI.</p>
<p><strong>The First Shots Fired in Bin Laden’s War Against America</strong></p>
<p>The story begins a year and half before El Sayyid Nosair, wearing a yarmulke, walked into the Morgan D Room at the New York Marriott and killed Kahane.</p>
<p>On four successive weekends in July 1989 (according to trial testimony), agents from the FBI’s Special Operations Group followed a group of “ME’s”—FBI-speak for “Middle Eastern Men”—from the al Farooq Mosque on Atlantic Avenue in Brooklyn to the Calverton shooting range, a large outdoor sand pit located at the end of Long Island.</p>
<p>Firing a series of weapons, including AK-47s and hand guns, the “ME’s” at the Calverton range included Nosair, then a 34-year-old janitor from Port Said, Egypt, who <a href="http://www.nytimes.com/1990/11/09/nyregion/police-say-kahane-suspect-took-anti-depression-drugs.html" target="_blank">reportedly</a> popped Prozac and worked in the basement of the Civil Courthouse on Centre Street in Manhattan; Mahmoud Abouhalima, aka “The Red,” a 6-foot-2-inch Egyptian cab and limo driver; Mohammed Salameh, a diminutive Palestinian; and Nidal Ayyad, a Kuwaiti who had graduated from Rutgers University. According to interviews with former FBI agent Jack Cloonan, each of them had been instructed by Ali Aboelseoud Mohamed, an ex-Egyptian Army commando from the unit that assassinated Anwar Sadat in 1981.</p>
<p>Mohamed was the <a href="http://web.me.com/netgraph1/peterlance.com/Ali_Mohamed.html" target="_blank">focus</a> of my last book, <a href="http://www.amazon.com/Triple-Cross-Penetrated-FBI-Fitzgerald/dp/0060886889" target="_blank"><em>Triple Cross</em></a>. In the early 1980s, shortly after being purged by the Egyptian Army for his radical views, Mohamed came under the influence of Ayman al-Zawahiri, the Cairo surgeon who had been jailed for a time for the Sadat murder and went on to form the Egyptian Islamic Jihad. By the end of the decade, after al-Zawahiri met Osama Bin Laden in Afghanistan and merged his Egyptian Islamic Jihad group into what would become al-Qaida, Ali Mohamed became the terror network’s principal espionage agent.</p>
<p>In 1984, Mohamed succeeded in infiltrating the CIA briefly in Hamburg, Germany, got past a watch list to enter the United States a year later, enlisted in the U.S. Army and, astonishingly, managed to get posted to the JFK Special Warfare Center at Fort Bragg, where elite Green Beret officers study. From there, he traveled to New York City on weekends to train the Calverton shooters.</p>
<p>Mohamed was so trusted by Bin Laden that he moved the Saudi billionaire’s entire entourage from Afghanistan to Sudan in 1991, set up al-Qaida’s training camps there, and trained Bin Laden’s personal body guards. He was also one of the principal planners in the simultaneous truck bomb attacks on the U.S. embassies in Kenya and Tanzania in 1998 that killed at least 223 and injured thousands.</p>
<p>Three of Mohamed’s Calverton trainees were convicted in the 1993 World Trade Center bombing plot. Nosair was convicted in the Kahane killing. A U.S.-born Muslim named Clement Hampton-El was convicted with Nosair in the 1993 “Day of Terror” plot to blow up the Lincoln and Holland tunnels, the George Washington Bridge, the United Nations, and 26 Federal Plaza, the building that houses the FBI’s New York office.</p>
<p>At the time of the Calverton surveillance, the FBI’s Special Operations Group clearly knew that these men were terrorists in training. New York Police Det. Tommy Corrigan, a former senior member of the NYPD-FBI Joint Terrorism Task Force, told me in an interview for <em>Triple Cross</em> that the surveillance stemmed from a tip that PLO terrorists were threatening to blow up casinos in Atlantic City. But for unknown reasons the FBI shut down the surveillance. By the end of that summer of 1989, the “ME’s” and their Green Beret-linked leader faded back into the shadows.</p>

<p>In July 1990, <a href="http://www.nytimes.com/1990/12/16/nyregion/islamic-leader-on-us-terrorist-list-is-in-brooklyn.html" target="_blank">following</a> a path similar to Ali Mohamed’s, Sheikh Omar Abdel-Rahman, the spiritual “emir” of al-Qaida who became known as “the blind sheikh,” got a visa, slipped past the same State Department watch list, and landed at John F. Kennedy International Airport in New York. He was met at the airport by Mustafa Shalabi, a big, burly 30-year-old electrical contractor from Egypt who <a href="http://www.nytimes.com/1993/04/11/nyregion/slaying-in-brooklyn-linked-to-militants.html" target="_blank">ran</a> the Alkifah Center at the al Farooq Mosque in Brooklyn.</p>
<p>The Alkifah was the principal U.S. office for the Makhtab al-Kidimat, often referred to as the MAK, a worldwide center of storefronts through which millions of dollars in cash was collected to support the Afghan Mujahadeen war against the Soviets, as Steven Emerson documents in <a href="http://www.amazon.com/American-Jihad-Terrorists-Living-Among/dp/0743234359" target="_blank"><em>American Jihad</em></a>. By 1989, a year before Abdel-Rahman arrived in New York, Bin Laden and al-Zawahiri had merged their new terror network with the MAK. Its leader, Abdullah Azzam, had been killed in a car bomb in Pakistan in November of that year. Once al-Qaida’s takeover of the financing network was complete, Bin Laden’s group had what amounted to a New York clubhouse at the <a href="http://www.historycommons.org/entity.jsp?entity=al-kifah_refugee_center" target="_blank">Alkifah Center</a>.</p>
<p>“Prior to that time—1988, ’89—terrorism for all intents and purposes didn’t exist in the United States,” says Corrigan, the retired Joint Terrorism Task Force investigator. “But Abdel-Rahman’s arrival in 1990 really stoked the flames of terrorism in this country. This was a major-league ball player in what, at the time, was a minor-league ballpark.”</p>
<p>In Corrigan’s view, the arrival of Abdel-Rahman was “a real coup for the local cell members like Shalabi, Nosair, Abouhalima, and Ayyad.” Before long, as court documents show, Abdel-Rahman was preaching at three separate mosques: the Abu Bakr on Foster Avenue in Brooklyn; the Al-Salam, located on the third floor of a dingy Jersey City building; and the Shalabi-connected al Farooq Mosque on Atlantic Avenue. At first, Shalabi welcomed the sheikh with open arms—even installing him in a Brooklyn apartment. But their warm relationship wouldn’t last very long. Abdel-Rahman coveted the cash rolling into the Alkifah—as much as $2 million, a year <a href="http://www.newyorker.com/archive/1995/06/12/1995_06_12_040_TNY_CARDS_000371208" target="_blank">according</a> to <em>The New Yorker</em>’s Mary Ann Weaver, but no one knows for sure. In any case, as the months went by, Abdel-Rahman began quarreling with Shalabi openly in the mosques.</p>
<p>***</p>
<p>By the fall of 1990, one of the Calverton trainees was growing more and more restless. El Sayyid Nosair, the janitor who worked in the courthouse basement, had joined Abdel-Rahman’s ultra-violent Islamic Group, or Al Gamma Islamyah, and he was itching to make his bones for the jihad. The newly uncovered FBI documents reveal a confession by Nosair that on the night of the Kahane murder he was aided by Alkaisi, then a 25-year-old Jordanian immigrant who worked as a cab driver in New Jersey and instructor at the al Farooq Mosque.</p>
<p>Describing Alkaisi as “a veteran of jihadist activity overseas,” including Afghanistan, Nosair told the feds that the two of them entered the Marriott East Side and that, just after Kahane had finished speaking, Nosair exclaimed, “This is the moment.” He then lunged forward with the same chrome-plated .357 Magnum photographed by the FBI at Calverton and fired the single shot that hit Kahane in the neck, blowing him to the floor.</p>
<p>As I later learned from Alkaisi’s former attorney, Robert L. Ellis, Alkaisi “left the Marriott and escaped by way of the subway station at 51st Street and Lexington Avenue.” Meanwhile, as Nosair rushed from the conference room, he was grabbed by Irving Franklin, a 73-year-old Kahane supporter. After a brief scuffle, Nosair shot the old man in the leg and raced toward the hotel’s front door, searching for a taxi.</p>
<p>His intended getaway driver was Mahmoud Abouhalima, who had been waiting outside, but moments earlier, the doorman had waved him away from the entrance, according to <a href="http://www.nytimes.com/1991/12/23/nyregion/for-jurors-evidence-in-kahane-case-was-riddled-with-gaps.html" target="_blank">reports</a>. So when Nosair ran from the hotel, he mistakenly got into a taxi driven by Franklin Garcia, a New York City cabbie. Suddenly, a young follower of Kahane jumped in front of the cab and prevented it from moving.</p>
<p>In the back seat, Nosair realized the error and <a href="http://www.nytimes.com/1991/12/18/nyregion/defendant-in-kahane-murder-trial-is-portrayed-as-a-victim-and-an-assassin.html" target="_blank">pointed</a> the barrel of the .357 at Garcia’s head, whereupon the taxi driver burst from the cab. Nosair then exited the taxi and ran down Lexington Avenue with the gun, where he was spotted by Carlos Acosta, a uniformed U.S. postal inspector, who drew his service weapon. Nosair fired first, wounding Acosta in the shoulder, just outside the edge of his flak vest, but the heroic officer dropped to his knee and returned fire as Nosair started to run, striking the Egyptian with a single shot. A pair of ambulances rushed both Nosair and Kahane to Bellevue Hospital’s trauma unit, where they were operated on in parallel stalls. The shooter survived; Kahane did not.</p>

<p>Later that night, Abouhalima and Mohammed Salameh (another Calverton shooter) regrouped at Nosair’s home in Cliffside Park, New Jersey.  But they were soon taken into custody as material witnesses by New York police after the house was raided. According to a series of FBI documents, detectives and FBI agents also seized 47 boxes in the raid—material that included prima facie evidence of an international bombing conspiracy with the World Trade Center as a target. Among the files seized was a potential hit list of prominent Jewish figures, including federal judge Jack B. Weinstein, a legendary jurist known as “the lion of the Eastern District.”</p>
<p>The seized material also contained <a href="http://www.peterlance.com/Triple_Cross_Appendix_1.pdf" target="_blank">documents</a> presumably left by Ali Mohamed, including Green Beret training manuals and communiqués from the Joint Chiefs of Staff that investigators believe he’d pilfered from Fort Bragg, a sign of al-Qaida’s intent to attack strategic U.S. targets. There was a Joint Chiefs of Staff “Warning Order,” addressed to eight separate U.S. military command centers, the White House, and the Defense Intelligence Agency, plus the U.S. embassies in Egypt, Sudan, Somalia, and Saudi Arabia.</p>
<p>The presence of these documents, many labeled “top secret for training,” not to mention Abouhalima and Salameh, suggested a conspiracy in the Kahane murder. Yet the very next day, NYPD Chief of Detectives Joseph Borelli concluded that the killing was a “lone-gunman” shooting. “There hadn’t been any political assassinations in New York in more than a decade and Borelli didn’t want one on his watch,” <em>Newsday</em> reporters Jim Dwyer, David Kocieniewski, Diedre Murphy, and Peg Tyre wrote in their book on the World Trade Center bombing, <a href="http://www.amazon.com/Two-Seconds-Under-World-America-/dp/0517597675/ref=sr_1_2?s=books&amp;ie=UTF8&amp;qid=1283373067&amp;sr=1-2" target="_blank"><em>Two Seconds Under the World</em></a>.</p>
<p>Although the raid on Nosair’s house was conducted by New York police and the FBI—which had the Calverton photos not just of Nosair but also of Abouhalima and Salameh—the latter two were <a href="http://www.nytimes.com/1993/08/27/nyregion/clues-hinting-at-terror-ring-were-ignored-officials-say.html" target="_blank">released</a> within hours and never charged in the crime.</p>

<p>By the summer of 1990, just about when Shalabi picked up Abdel-Rahman at JFK, the Brooklyn Alkifah Center was <a href="http://www.nytimes.com/1993/04/11/nyregion/after-blast-new-interest-in-holy-war-recruits-in-brooklyn.html" target="_blank">grossing</a> more than $100,000 per month in cash for the “struggle.” So when Nosair was arrested, Shalabi took it upon himself to raise the money for his legal fund, particularly after star attorney William Kunstler signed on for the defense. By the time Nosair’s trial began in late 1991, $163,000 had poured in—$20,000 of which, court documents would later show, came from Osama Bin Laden, who had been contacted by Nosair’s cousin.</p>
<p>But Shalabi was intent on making his own decisions. While respectful of al-Qaida, the terror network that had consumed the financing system known as MAK, Shalabi remained loyal to Abdullah Azzam, his old mentor, who had wanted to use the money to set up a Taliban-like government in Afghanistan. That put him in direct conflict with Bin Laden and the Egyptians around him, who wanted the funds to be used for the worldwide jihad. And even though Shalabi himself sponsored Abdel-Rahman’s visa entry into the United States, he balked when Abdel-Rahman demanded that some of the Alkifah’s monthly income be used for a fund to help overthrow Hosni Mubarak in Egypt.</p>
<p>And so by the late summer of 1990, tensions were mounting between Shalabi and Abdel-Rahman. In the Brooklyn-based Abu Bakr Mosque, Abdel-Rahman began denouncing Shalabi openly as a “bad Muslim.” Abdel-Rahman even suggested that his fellow Egyptian was embezzling the Alkifah’s funds. Handouts were circulated under the Sheikh’s name. “We should not allow ourselves to be manipulated by his deviousness,” the leaflets said. Other handouts included mini <em>fatwas</em> declaring that Shalabi was “no longer a Muslim.”</p>
<p>Soon Shalabi began to fear for his life.</p>

			<content:encoded><![CDATA[<p>They had the wrong guy. It was a case of mistaken identity. That’s what I told the dudes on the FBI-NYPD Joint Terrorism Task Force that morning when I was coming home to my strange new abode from a peaceful breakfast and these two big guys in trench coats flashed their badges, threw me up against the brick wall, and frisked me for weapons. Aside from the take-out bagel, which on some mornings could be considered a weapon of sorts, they didn’t find any, but they weren’t through with me. They said they were looking for a certain fugitive and they thought I might be he. I had to prove who I wasn’t. Which meant, afterwards, I had to think about who I was.</p>
<p>I didn’t know the whereabouts of the fugitive they were seeking, although I did know who he was. I’d seen him on the floor below me in the red brick tenement building on Bleecker near Bowery on the Lower East Side of Manhattan. The floor that served as the headquarters of what was invariably called “the extremist Jewish Defense Organization.” Extremist? I’d heard vague rumors of a connection with the attempted murder of an aging Nazi war criminal on Long Island, although I never knew if there was a real connection and still don’t know if that was why one of them became a fugitive.</p>
<p>But they were, in one way or another, extreme. Some might say extreme moralists, in a slightly Dostoevskian Underground Man way. Others might call them single-minded Jewish fanatics because the cause that gave them birth was the bitter struggle of millions of Soviet Jews to survive and escape vicious repression by openly anti-Semitic Russian authorities. A struggle given more emotional intensity by the fact that Americans, and particularly the human-rights wing of American liberalism, composed in great part by Jews, seemed detached if not disdainful of the plight of their co-religionists, content to follow the lead of the Nixon-Kissinger policy: Don’t make noise about Soviet Jews because it threatened the delicate preservation of detente between nuclear powers.</p>
<p>And so it was left to outsider Jews, to “fanatics,” to “extremists,” like Meir Kahane, to make noise about what was happening behind prison bars in the Soviet Union, the prison bars <em>of</em> the Soviet Union: the murders, the imprisonments, psychiatric lock-ups for dissidents, the deprivation of even the few rights of non-Jewish citizens of the Soviet police state.</p>
<p>The more one reads—as in Gal Beckerman’s forthcoming book, <a href="http://www.amazon.com/When-They-Come-Well-Gone/dp/0618573097/ref=sr_1_1?ie=UTF8&amp;s=books&amp;qid=1274122420&amp;sr=8-1" target="_blank"><em>When They Come for Us, We’ll Be Gone</em></a>—on the struggle to save Soviet Jews, the more one understands the frustration with official Jewish organizations that gave rise to the impulse to extremism.</p>
<p>Now, the “extremist JDO” is often confused with the original “extremist JDL,” the Jewish Defense League, founded by an extremist, Kahane, which earned <em>its</em> extremist label by being <a href="http://books.google.com/books?id=F-QCAAAAMBAJ&amp;lpg=PA30&amp;dq=meir%20kahane&amp;as_pt=MAGAZINES&amp;pg=PA30#v=onepage&amp;q&amp;f=false" target="_blank">accused</a> of bomb plots against Carnegie Hall and other venues for touring Soviet orchestras and ballet groups that were used as the window dressing for detente.</p>
<p>It should have been considered a universal human-rights cause, but it was often dismissed as a right-wing—because anti-Communist—cause. I must admit to my own guilt here.</p>
<p>In any case I’ve lost track of the details, but there’s extremist and there’s extremist and it’s my understanding that the JDO, my downstairs neighbors, broke off from the JDL because the JDL wasn’t extremist <em>enough</em>. It wouldn’t go the extra mile. And the JDO under its founder, <a href="http://www.nytimes.com/1992/03/08/us/head-of-jewish-group-is-arrested-in-murder-case.html" target="_blank">Mordechai Levy</a>, began to focus its attention on other American anti-Semitic manifestations, including neo-Nazi, white supremacist, Klan, and Holocaust-denier groups. And the alleged Nazi war criminals the Justice department was not pursuing vigorously enough for their notion of “justice.”</p>
<p>Perhaps for this reason, “the enemy of my enemy,” etc., the JDO found a haven in the various New and Old Left enclaves of the Lower East Side, long home to Jewish fanatics, now haven for the remains of the counterculture, including such figures as <a href="http://www.amazon.com/RightWing-Bob-Liberal-Media-Doesnt/dp/1439256152/" target="_blank">A.J. Weberman</a>, the well-known “Dylanologist” who was a patron of the JDO and someone I became familiar with during my first reporting job, the perilous post of counterculture reporter for <em>The Village Voice</em>. It was a job in which one met all sorts of exotic characters. Indeed I recall when Weberman lived in the JDO building, I had occasion to meet a figure known as “One-Legged Terry,” an American-born Israeli who was said to be responsible for Bob Dylan’s pre-born-again engagement with Judaism.</p>
<p>But I was not seeking a cause, just a refuge, a place to lay my head after a divorce. And it sounded like a good deal, two floors in a solidly built brick tenement building. On the other hand, I didn’t realize the unwanted attention it would entail. I was not seeking to find myself frisked by the Joint Terrorism Squad, however mistakenly.</p>
<p>It was a strange arrangement and a strange episode in my life but, looking back on it, the mistaken-identity episode and my conversations and arguments with the JDO guys did cause me to think about my <em>real</em> identity and its lack of definition. And, eventually, through one Killer Question, gave me the impetus to write <a href="http://www.amazon.com/Explaining-Hitler-Search-Origins-Evil/dp/006095339X" target="_blank"><em>Explaining Hitler</em></a>.</p>
<p>Mistaken identity? What distinguished my Jewishness from the vigilante Jewishness of the JDO?</p>
<p>Well, I was not an observant Jew, not even much of a believer, though not an atheist. Just not a monotheist. So, sue me.</p>
<p>But I loved Jews and Jewish culture and living for the first time in a Jewish city. (I’d grown up in non-Jewish small-town suburb and gone to school in New Haven and had not experienced much anti-Semitism in either locale; now I was drowning in philo-Semitism, and I liked it.) I will admit that what made me identify as Jewish more than anything else was the Holocaust, rage at it and its perpetrators. Even though I had no direct ancestors die in it, I knew they could have. And shortly before he died my father told me about a second cousin of his who lived in Paris and probably died in the camps. I came to feel Hitler’s victims were all part of my extended family.</p>
<p>I know I also had the vague idea for a novel that would attempt to exorcise this, an alternate history in which a group of Jews took on Hitler and the Nazis before they came to power—and won. I think it was derived from a legendary, probably apocryphal, story that back in the 1930s the Lower East Side’s own Jewish mobster king, Meyer Lansky, came to Fifth Avenue to ask august spokesman for the Jewish Establishment, Rabbi Stephen Wise, do you want me to put a contract out on Hitler? And the dignified civilized rabbi said no, it was not the right thing to do, it might backfire, be bad for his image, bad for the image of Jews, something. Too extremist. Lansky left, although there are stories that he didn’t entirely drop the idea right away. I haven&#8217;t either.</p>
<p>Still, from day to day it wasn’t visceral, my sense of Jewish identity and rage. I preferred the Simon Wiesenthal approach: hunting down ex-Nazis, bringing them to justice, and trying them (like Eichmann) for their crimes against humanity, not shooting them through Long Island screen doors.  But could I utterly condemn the “wild justice” (as revenge is sometimes called) the fugitive I’d been mistaken for had been suspected of? What’s the morality of killing an 80-year-old Nazi war criminal?</p>

			<content:encoded><![CDATA[<p>It’s been a year since the terrorist attacks in Mumbai that killed more than 170 people, including six occupants of the local Chabad House, and there has been some progress toward prosecuting one of the alleged perpetrators. David Coleman Headley, a 49-year-old Pakistani immigrant to the United States, was arrested last month in Chicago en route to Pakistan and charged with involvement in a plot to attack Denmark after the Muhammad cartoon <a href="http://en.wikipedia.org/wiki/Jyllands-Posten_Muhammad_cartoons_controversy">fiasco</a>. The FBI quickly determined that he was also likely a suspect in the Mumbai attacks. Indian authorities have linked Headley—who was head of an immigration law firm in Mumbai from 2006 to 2009—to Pakistani terror group Lashkar-e-Taiba and determined that he cased all 10 locations targeted by the terrorists last November. They plan to push the United States for Headley’s extradition in January.</p>
<p>According to an Indian National Investigation Agency report, Headley gained entrance to the Chabad center by posing as a Jew, and the FBI discovered a copy of a book called <em>To Pray as a Jew</em> among his belongings. A rabbi in India, who gave a tour of the wreckage to Canadian Prime Minister Stephen Harper this week, is still baffled by the tragedy: “It was bizarre that the terrorists should come and make this one of their key hunting grounds.… It didn&#8217;t have any meaning in any nationalistic sense, in any political sense.”</p>

			<content:encoded><![CDATA[<p>Stewart David Nozette, a 52-year-old American scientist who worked for the Energy Department and NASA and helped prove that there’s water on the moon, was arrested Monday for trying to sell classified state secrets to an FBI agent posing as a Mossad operative. In addition to a long career with the U.S. government, he also spent 10 years as a technical adviser for a consultant company owned by the Israeli government, the Associated Press is reporting. The criminal complaint also suggests a history of odd behavior, according to the wire service: In January of this year, he allegedly traveled outside the United States with two thumb drives and didn’t return with them, and he allegedly told a colleague that if the U.S. government ever tried to jail him for an unrelated crime, he’d go to Israel and “tell them everything” he knows. That was enough to get the FBI to embark on an elaborate sting operation in which Nozette ponied up information about U.S. satellites for $2,000 in cash, then gave more on “nuclear weaponry, military spacecraft or satellites, and other major weapons systems” for $9,000. </p>
<p>So does this mean Nozette a spy who got caught or a megalomaniac with high-level clearance? So far, signs suggest the latter. “The complaint does not allege that the government of Israel or anyone acting on its behalf violated US law,” the AP says.</p>

			<content:encoded><![CDATA[<p>Hold on for a second, and pay close attention: we have here a brand-new twist to an already labyrinthine spy tale. In 2005, Larry Franklin, the Pentagon’s former Iran desk officer, pleaded guilty to disclosing secret information on the U.S.’s Iran and Iraq policy without authorization to two members of the American Israel Public Affairs Committee and one official at the Israeli Embassy. However, Franklin now <a href="http://www.washingtontimes.com/news/2009/jul/29/former-double-agent-says-fbi-turned-on-him/print/">claims</a> that he had in reality been <em>spying on AIPAC</em> on behalf of the FBI, before his FBI handlers turned on him and told him he would face espionage charges, which were later downgraded to the unauthorized disclosure charges. Specifically, Franklin asserts, after the FBI began investigating him in 2004 for allegedly leaking information to CBS News about prominent Iraqi exile Ahmed Chalabi’s Iranian ties, the Bureau asked him to go undercover to try to learn more about alleged Israeli spying, and to help it build a criminal case against the two AIPAC officials, Steven Rosen and Keith Weissman. (These men were eventually indicted, but then saw all charges against them dropped this spring.) Tensions between Franklin and the U.S. government first arose when he dissented from Pentagon thinking that Iran could prove a help in the then-impending invasion and occupation of its neighbor, Iraq; Franklin believed Iran would refuse to help the U.S., and first established a relationship with the AIPAC and Israeli officials in an effort to influence U.S. policy in a manner aligned with his views on the matter.</p>

			<content:encoded><![CDATA[<p>In another indication of the increasingly ambitious and global nature of Israeli organized crime, a trend I’ve been covering in a Tablet Magazine <a href="http://www.tabletmag.com/news-and-politics/11893/holy-land-gangland-part-ii/">series</a> this week, an Israeli court <a href="http://www.jpost.com/servlet/Satellite?cid=1248277909047&amp;pagename=JPost%2FJPArticle%2FShowFull">ruled</a> yesterday that the brothers Meir and Yitzhak Abergil, two of Israel’s most notorious gangsters, and a few of their associates will be extradited to the United States. There, they will face the music for allegedly running one of the world’s largest Ecstasy rings in cooperation with the Vineland Boyz, a Los Angeles-based Latino gang. (The partnership had landed the brothers on the U.S. State Department’s list of the top 40 drug importers.) Headquartered in Israel’s northern coastal city of Netanya, the Abergils were arrested last August following a sweeping FBI investigation that spanned six years and involved law enforcement from more than ten countries across North America, Europe, East Asia, and the Middle East. The feds’ indictment assesses the Abergils’ fortune in the millions, and exposes their complex international enterprise: drugs were manufactured in the family’s laboratories in Belgium and then smuggled into California by ingenious means, including stuffing them into toy tigers.</p>

			<content:encoded><![CDATA[<p>FBI agents arrested several rabbis this morning in New Jersey and New York as part of an investigation into what the U.S. Attorney’s office in Newark, N.J., described as a “high-volume, international” money-laundering conspiracy. The mayors of Hoboken and Secaucus, N.J., a state assemblyman, and the deputy mayor of Jersey City were also arrested as a result of a public-corruption probe. The Newark <I>Star-Ledger</I> is reporting the rabbis came from Syrian Jewish communities in Deal, N.J., a shore town popular with wealthy Syrian Jews, and Brooklyn. At least one synagogue and one yeshiva, both in Deal, were searched this morning by FBI agents. An FBI spokesman tells Tablet the 30 people arrested, including the rabbis, are expected to appear in a Newark federal court this afternoon. </p>
<p>The New Jersey U.S. Attorney’s office was headed until last winter by Christopher Christie, a Republican known for aggressive investigations of public corruption who is currently running for governor against the incumbent Democrat, Jon Corzine. A poll released <a href="http://www.nj.com/politics/index.ssf/2009/07/atlanta_a_poll_conducted_by.html">yesterday</a> puts Christie ahead by 15 percentage points. </p>
<p><B>UPDATE, 12:45 p.m.:</B> The Newark <I>Star-Ledger</I> is reporting that this morning’s sweep began with an investigation into money transfers by members of the Syrian Jewish community in New York and New Jersey to public officials in connection with real-estate transactions. </p>
<p>According to a criminal complaint filed this morning, a cooperating witness helped FBI investigators capture Hoboken Mayor Peter Cammarano offering to help ease zoning restrictions in exchange for campaign cash. The <I>Asbury Park Press</I> identifies the witness as Solomon Dwek, a once-prominent member of the Syrian community in Deal, New Jersey, who was arrested in 2006 after bouncing a $25 million check. A message left seeking comment from Dwek’s attorney, Christopher Porrino, was not immediately returned.</p>
<p>A separate complaint filed in the case of Assemblyman Daniel Van Pelt, a Republican, alleges the lawmaker offered a cooperating witness assistance securing coastal development permits in exchange for money, and mentioned a prospective congressional run. It is not clear whether that witness is the same person mentioned in the Cammarano complaint. </p>
<p>The <I>Asbury Park Press</I> and the <I>Wall Street Journal</i>, citing anonymous sources, are also reporting that the case also involves allegations of trafficking in human body parts and that one of those arrested is an organ dealer. </p>
<p>This morning’s sweep included arrests in the Williamsburg, Flatbush, and Borough Park neighborhoods of Brooklyn. The <I>Yeshiva World News</I> is reporting that there will be a public gathering in Brooklyn’s Gravesend neighborhood to recite prayers on behalf of all those arrested; Robert Nardoza, a spokesman for the U.S. Attorney’s office in Brooklyn, told Tablet that anyone picked up in New York will be taken to New Jersey, where the case is being prosecuted. </p>

It’s called <em>J. Edgar Klezmer – Songs from My Grandmother’s FBI Files</em>. In the show, Eve combines archival materials, spoken word, and original songs from a variety of genres to explore the life of her paternal grandmother, Adele Sicular, who was a psychiatrist and activist in New York City.</p>
<p><em>J. Edgar Klezmer</em> will be performed in New York City on June 4th at the <a href="http://www.jccmanhattan.org/category.aspx?catid=1022&amp;pID=1000">Manhattan JCC</a>.</p>
